These Terms & Conditions govern your access to and use of mochisim.com and the purchase and use of eSIM data plans provided by MochiSim.

By purchasing an eSIM or using our website, you agree to these Terms & Conditions. If you do not agree with these Terms, please do not use our services.

1. About MochiSim

MochiSim is a brand operated by Cloud Dynamics Ltd, a company registered in Hong Kong.

Throughout these Terms, "MochiSim", "we", "us" and "our" refer to MochiSim.

2. eSIM Services

MochiSim provides prepaid eSIM data plans for travellers.

Our eSIM plans provide mobile data access through third-party mobile network operators and connectivity providers.

Most MochiSim plans are data-only plans. Some plans may include additional features, such as receiving calls or other services, when specifically stated in the plan description.

Unless expressly stated otherwise, MochiSim plans do not include the ability to make phone calls or send SMS messages.

Each plan may have different conditions regarding:

• supported countries or regions;
• included data allowance;
• validity period;
• activation period;
• network availability;
• speed limitations; and
• fair usage policies.

These conditions will be displayed before purchase.

3. Device Compatibility

Before purchasing an eSIM, you are responsible for ensuring that your device:

• supports eSIM technology;
• is compatible with the purchased eSIM;
• is unlocked and able to connect to other networks; and
• meets any technical requirements necessary for installation.

MochiSim is not responsible for unsuccessful installation caused by an incompatible, locked, unsupported, or incorrectly configured device.

If you are unsure whether your device supports eSIM, we recommend checking compatibility before purchase.

4. Orders and Payment

To purchase an eSIM, you must provide a valid email address.

No user account is required to complete a purchase.

You are responsible for ensuring that your email address is correct, as your eSIM installation instructions will be sent to this address.

Available payment methods may include:

• credit cards;
• debit cards;
• Apple Pay; and
• Google Pay.

Payments are processed through third-party payment providers.

An order is considered completed once payment has been successfully authorised and the eSIM order has been confirmed.

MochiSim reserves the right to cancel orders in cases of suspected fraud, payment issues, technical errors, or circumstances where the service cannot reasonably be provided.

5. eSIM Delivery

After successful payment, MochiSim will send your eSIM installation details by email.

Delivery is usually completed within minutes. However, depending on the relevant connectivity provider, delivery may occasionally take several hours.

If you do not receive your eSIM, please check your spam or junk folder before contacting:

MochiSim is not responsible for delays caused by incorrect email addresses provided by the customer.

6. Activation and Validity

Unless otherwise stated in the product description, an eSIM plan begins its validity period when it first connects to a supported network in the destination country or region.

The activation period available after purchase depends on the specific plan.

Most plans allow activation within 60 or 90 days after purchase. If no activation period is specified, the eSIM must be activated within 30 days after purchase.

Once the activation period has expired, the eSIM may no longer be usable.

After activation, the plan remains valid until:

• the included data allowance is fully used; or
• the validity period expires,

whichever occurs first.

Unused data or remaining validity cannot be transferred or extended unless expressly stated otherwise.

7. Network Coverage and Performance

MochiSim provides access to mobile networks operated by third-party providers.

Although we aim to provide reliable connectivity, MochiSim does not control the infrastructure, coverage, availability, or performance of third-party networks.

Actual service availability may vary depending on:

• location;
• local network availability;
• device compatibility;
• network congestion;
• maintenance;
• weather conditions; and
• other factors outside our reasonable control.

The availability of an eSIM plan in a country or region does not guarantee uninterrupted coverage in every location.

8. Speed and 4G/5G Availability

MochiSim aims to provide access to 4G or 5G networks where available and supported by the device, plan, and local network.

We do not guarantee a specific speed or continuous access to 4G or 5G connectivity.

Actual speeds may vary depending on network conditions, location, device capabilities, and operator policies.

9. Unlimited Plans and Fair Usage

Some MochiSim plans may be marketed as unlimited.

Unlimited plans may be subject to fair usage policies established by our connectivity providers.

Fair usage policies may include:

• temporary speed reductions;
• high-speed data limits;
• daily usage limits; or
• restrictions intended to prevent abuse or excessive network consumption.

Where applicable, relevant limitations will be indicated in the product description.

10. Hotspot and Tethering

Hotspot or tethering functionality is available only when supported by the specific plan and network provider.

If hotspot restrictions apply, they will be indicated in the relevant product description.

11. Refunds and Cancellations

MochiSim offers refunds within 7 days of purchase provided that:

• the eSIM has not been installed;
• the eSIM has not been activated;
• the service has not been used; and
• the plan has not expired.

Once an eSIM has been installed or activated, it cannot be refunded under this voluntary refund policy.

If an eSIM cannot be activated or used due to a technical issue attributable to MochiSim or our connectivity provider, please contact:

We will make reasonable efforts to investigate and resolve the issue, including providing technical assistance or a replacement where appropriate.

This refund policy does not affect any mandatory consumer rights that may apply under applicable law.

12. Acceptable Use

MochiSim services are provided for personal use only.

You agree not to use MochiSim services for:

• illegal activities;
• fraud;
• abuse of networks;
• unauthorised resale;
• commercial exploitation without permission;
• activities that interfere with network security or availability; or
• any other prohibited activity under applicable laws.

MochiSim may suspend or terminate access to services where there is reasonable evidence of fraud, abuse, unlawful activity, or serious violation of these Terms.

13. Limitation of Liability

To the maximum extent permitted by applicable law, MochiSim shall not be responsible for:

• interruptions caused by third-party mobile operators;
• lack of coverage in specific locations;
• device incompatibility;
• incorrect installation by the customer;
• loss caused by misuse of the service; or
• indirect losses arising from the use of the service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Consumer rights that cannot legally be excluded remain unaffected.

14. Privacy

Your personal data is processed according to our Privacy Policy available on mochisim.com.

15. Website Availability

MochiSim aims to keep its website and services available at all times but does not guarantee uninterrupted access.

We may temporarily suspend access due to maintenance, technical issues, security measures, updates, or circumstances beyond our reasonable control.

16. Changes to These Terms

MochiSim may update these Terms & Conditions from time to time to reflect changes in our services, legal requirements, or business practices.

The Terms applicable to your purchase will be the version available at the time your order was completed.

17. Governing Law

These Terms shall be governed by the laws applicable to Cloud Dynamics Ltd, without limiting mandatory consumer protection rights applicable in the customer's country of residence.
